Constitutional Court partially upholds Robert Kocharyan’s appeal

The Constitutional Court today announced the decision on second President Robert Kocharyan’s appeal on conformity of Part 2 of Article 135 and Article 35 of the Criminal Procedure Code with the Constitution of the Republic of Armenia.

The Court decided that Article 35 of the Criminal Prosecution Code contradict the relevant articles of the Constitution and is invalid when it comes to the non-inclusion of the  immunity of the functions of officials endowed with special protection by the virtue of Constitution among circumstances excluding criminal proceedings.

The Court also decided that Part 2 of Article 135 complies with the Constitution.
